In fact, the city’s own standards required padding on playground pavement. This established a reasonable safety standard with which the city was required to comply.
The court reasoned that when the city set a standard for padding on playgrounds, it sought to provide against a reasonably foreseeable danger. The child’s accident was a result of the breach of a duty by the city to provide a safe condition in the playground.
